Real Property Transfers and Encumbrances: Mortgages, Easements and Encroachments

Hawaii is unique in that it has two statewide land recording systems – the Regular System and Land Court. Certain properties are recorded in the Land Court system, while others may be recorded in the Regular System, or in both systems.

Unlike many other states, the individual counties do not record property conveyance or encumbrance documents. In Hawaii, all real property conveyance and encumbrance documents are recorded at the State of Hawaii Bureau of Conveyances. The Bureau of Conveyances only records documents that meet the State of Hawaii’s recording requirements.

To ensure proper recordation of your real property conveyance, it is important to utilize the services of a licensed attorney.
